Pursuant to a Judgment of Foreclosure and Sale duly granted in the above-entitled action and entered in the St. Lawrence County Clerk's Office on July 6, 2010, I, Michael L. Levato, the undersigned Referee in said Judgment named will sell at public auction at the new main entrance of the St. Lawrence County Courthouse, 48 Court Street, in the Village of Canton, County of St. Lawrence and State of New York, on Monday, August 23, 2010, at 8:30 o'clock in the forenoon thereof the premises described as follows:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Fine, St Lawrence County, New York, and being Lot #23, 29, 30 and 31 as shown on a map dated June 20, 1962, entitled "Star Lake Estates" as prepared by F. Donald McKee, L.S. 32422, said map being duly recorded in the St. Lawrence County Clerk's Office on the 8th day of July, 1982.
ALL of the above lots are conveyed SUBJECT to and with the BENEFIT of the following:
1. An easement for the public water system now serving the Star Lake Estate, which easement shall extend to the present water lines or any continuation thereof as may be hereinafter required for the service of the premises herein described or any other lot as shown on said map of Star Lake Estates.
2 .A right-of-way for electric light lines to service each of the lots as shown on said map of Star Lake Estates.
3. A right-of-way on all public roads as shown on said map of Star Lake Estates and designated as public rights-of-way and the said public rights of way may be used by the general public.
ALSO granting, in common with all the other owners of lots as shown on the said map of Star Lake Estates the use of the rights-of-way and areas designated as "Common Beach".
THAT in the event the sewer system for the premises herein described is situated in whole or in part on other premises, or is in joint use with other premises, an easement for said continued usage is hereby granted with the right of entry at any time for repairs and if any sewer system of any other lot or lots is on the premises herein described, the same is excepted and reserved. That in the event the present sewer system for the premises herein described is in any other lot and if said system should hereafter become totally unusable, any new sewer installation is to be situate solely on the premises herein described and any previous easement on any ether premises is void.
EXCEPTING AND RESERVING all public easements, reservations, conditions and restrictions of record affecting said premises.
BEING AND INTENDING to describe and mortgage the same premises conveyed by Frederick C. Greene to Jack Thomas, Jr. by deed recorded in the Office of the St Lawrence County Clerk in Liber 1013 of Deeds at Page 1075. ALSO being and intending to describe and mortgage the same premises conveyed by Frederick C. Greene to Jack Thomas and Mary Thomas by deed recorded in the Office of the St Lawrence County Clerk in Liber 1081 of Deeds at Page 787. ALSO being and intending to describe and mortgage the same premises conveyed by Robert and Barbara Dietrich to Jack Thomas and Mary Thomas by deed recorded in the Office of the St Lawrence County Clerk as Instrument #2001-17111.
THE mortgagors covenant with the mortgagee that they each have received two copies of the Notice of Right of Rescission, that they have had such notice for at least three days, and that they have not elected to cancel or rescind this transaction.
THE mortgagors acknowledge that the Mortgage Loan Closing and Disclosure Statement has been received from the Mortgagee in ample time for careful consideration prior to the execution of this Mortgage.

The sale is made and the above-described premises are sold subject to the existing condition of the property, any restrictions and easements of record, such state of facts as a current survey might reveal, the right of redemption of the United States of America, which are or may become liens on the premises at the time of sale with such interest or penalties which may have lawfully accrued thereon to the date of payment, the rights of any person in possession, violation of zoning ordinances and environmental codes and orders or codes of any municipal, state or federal department, and any purchaser shall pay for any required deed stamps, recording costs and New York State capital gains tax, if any.

SAND BID

The Town of Macomb is accepting bids for sand for the winter of 2010/2011, 4,500 yards. Bid amount shall include the cost of sand self haul in the pit and a delivered price to the town of Macomb Highway Department. Bid specifications can be picked up at the highway shop. All bids must be turned in by noon on the 10th of August to the Town Clerk Office in a sealed envelope with name of company on it. Office hours are Tuesday & Thursdays from 9 – 3.
